  1. PROMOTION DESCRIPTION: The driversselect College Championship Giveaway (the "Sweepstakes") begins at 12:00:00 PM (CST) on 3/12/10 and runs through 2:00:00 PM (CST) on 3/29/10 (the “Promotion Period”). By participating in the Sweepstakes, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of driversselect (the "Sponsor") which shall be final and binding in all respects.

          • VIA TEXT MESSAGING: During the Promotion Period, using a two-way text message-capable wireless device, text “DRIVERS” to short-code 30364. Once your text message is received, you will receive a reply text message asking you to indicate your email address. Only after you reply to that text message with your eligible email address will you automatically be credited with one entry in the Sweepstakes. Entry into the Sweepstakes consists of receiving four (4) teams participating in the 2010 Men’s College Basketball Championship Tournament.  Each entry will include one (1) team from each of the four (4) designated tournament regions.  Text message entries must be received by 2:00:00 PM (CST) on 3/29/10. Limit one text message entry per wireless account per promotional period. IF MORE THAN ONE TEXT MESSAGE ENTRY IS RECEIVED FROM ONE WIRELESS ACCOUNT, ONLY THE FIRST ENTRY SUBMITTED WILL BE CONSIDERED VALID. Sponsor cannot guarantee this program will be available via all Text carriers. The text-messaging portion of the promotion will be available on participating wireless carriers only and requires a two-way text message-capable wireless device. Wireless device carrier’s instructions for text messaging may vary. Standard text messaging and data rates may apply. Your wireless service provider may charge you for each text message you send and receive. The Website's database clock will be the official timekeeper for this Sweepstakes. Except as otherwise contemplated in these Official Rules, information collected in connection with this Sweepstakes will be used by Sponsor in accordance with its online privacy policy, which can be found at www.driversselect.com.
          • VIA MAIL-IN: On a plain piece of 3” x 5” paper, sign your name and also handprint your complete name, address, birth date, email address, daytime phone number and the keyword “DRIVERS”. Mail your entry in a hand-addressed #10 envelope with first-class postage affixed, to: driversselect College Championship Giveaway Alternate Method of Entry, c/o SCA Promotions, 3030 Lyndon B. Johnson Freeway, 3rd Floor, Dallas, Texas, 75234. Only one entry per envelope. Only one mail-in entry per promotional period.  No mechanically reproduced entries permitted. All entries must be postmarked by 3/24/10 and received by 2:00 PM (CST) on 3/29/10. Not responsible for lost, late, postage due, mutilated, illegible or incomplete entries. All entries become the sole property of the Sponsor and will not be returned.

       

      • HOW TO PLAY: Each eligible entry will receive four (4) teams, one (1) from each of the four (4) designated regions, participating in the Men’s College Basketball Championship Tournament.  In the event the contestant’s four (4) listed teams advance to the final weekend of the tournament, the contestant is a grand prize winner.  Each contestant may only receive one (1) entry during the promotional period.  Each eligible entry will receive their four (4) participating teams in a random determination process.  Sponsor has no control, determination, or responsibility for which participating teams are distributed for each entry.  If any of the four (4) teams included with a customer entry lose their respective game and do not advance to the final weekend of the tournament, the entry is not a winner. All four (4) teams must advance to the final weekend of the tournament for the entry to be considered a winner. The potential winners will be notified by telephone and/or email.  Sponsor shall have no liability for any winner notification that is not received by any potential winner for any reason.    
      • PRIZES AND APPROXIMATE RETAIL VALUES (ARV): Grand Prize: Grand Prize includes a 4-day/3-night trip for winner and one (1) adult guest to Indianapolis, IN on or about 4/3/10 – 4/6/10, travel accommodations, three (3) nights hotel standard accommodations (one room/double occupancy), a ticket voucher which could be used to purchase two game tickets for winner and one (1) guest to the basketball games being held in Indianapolis, IN on 4/3/10 and 4/5/10 and one (1) $200.00 travel stipend, awarded in the form of a gift card. Gift card is subject to terms and conditions established by the issuer and is not redeemable for cash. Sponsor is not responsible for any expense incurred with winner’s purchase that exceeds the value of the gift card.  Sponsor is not responsible for lost or stolen vouchers or tickets, cancelled or postponed events, changes in date, time or venue of events.  Winners will be responsible for all transportation to and from airport, gratuities, meals, baggage fees, and any other incidental costs or expenses not identified in these rules. ARV $10,000.00 (up to two grand prizes may be awarded at $5,000 per prize package). In the event of more than two grand prize winners, a random drawing will be held among qualified winning contestants to determine the two grand prize winners.  Under no circumstance will more than two grand prizes be awarded.  Prize consists only of the items specifically listed as part of the prize. Winners will be responsible for all meals, beverages, gratuities, and any other incidental costs or expenses not identified in these rules. ARV of all prizes: $10,000.00. Prizes consist only of the item(s) indicate as part of the prize. Limit one (1) prize per household.

       

      • GENERAL RULES: This sweepstakes is open to legal residents of the United States, excluding NY, FL, and RI, who are 18 years or older at time of entry. Employees of driversselect and its parents companies, affiliates, subsidiaries, distributors, advertising and promotion agencies, their immediate family members and/or those living in the same household of each are NOT ELIGIBLE. This sweepstakes is void where prohibited by law, and is subject to federal, state and local laws and regulations. All federal, state and local taxes are the sole responsibility of winners. Potential Grand Prize winners will be required to execute an Affidavit of Eligibility/Release of Liability/Prize Acceptance form within two (2) days of attempted notification. By accepting prize, winners agree to hold driversselect and their affiliates, subsidiaries, advertising and promotion agencies, as well as their respective affiliates, officers, directors, agents, employees and assigns, harmless against any and all claims arising out of use or misuse of prize.  Winners assume all liability for any injury or damage caused, or claimed to be caused, by participation in this promotion or use or redemption of any prize.  Acceptance of prize constitutes permission to use winner’s name and/or likeness for purposes of advertising and trade without further compensation, unless prohibited by law. By participating in this promotion, entrants agree to be bound by the official rules and the decisions of the Sponsor. No substitution or transfer of prize permitted, except Sponsor reserves the right to award a prize of equal or greater value. Sponsor not responsible for any typographical or other error in the printing of this offer, administration of the sweepstakes or in the announcement of prizes. Except where prohibited, entrants agree that any and all disputes, claims and causes of action arising out of or connected with this sweepstakes or the prizes awarded shall be resolved under the laws of the State of Texas in the U.S., without respect to any conflict of law issues, and entrants agree that such shall be resolved individually, without resort to any form of class action, and exclusively by the Federal or State Courts of Texas. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any promotion materials and the terms and conditions of the official rules, the official rules shall prevail, govern and control. Sponsor not responsible for incomplete, lost, late, damaged, illegible or misdirected mail/e-mail/SMS text messages or for any technical problems, faulty, incorrect or mistranscribed data/mobile phone/SMS-enabled wireless device transmissions, incorrect announcements of any kind, technical hardware or software failures of any kind including any injury or damage to any person’s SMS-enabled wireless device or computer related to or resulting from participating in or experiencing any materials in connection with this Sweepstakes. Sponsor not responsible for malfunctions or breakdown of any network systems, unavailable service connections, lost, incomplete, fault network connectivity of any kind, failures of any service providers, or any combination thereof, which may limit a person’s ability to participate in this Sweepstakes. In the event of a dispute regarding any text message entry, the entry will be deemed made by the authorized account holder of the SMS-enabled wireless device phone number submitted at the time of entry (i.e., the natural person who is assigned to a SMS-enabled wireless device phone number by an Internet access provider, online service provider, wireless phone carrier network or other organization responsible for assigning phone numbers for the SMS-enabled wireless device). Potential winner may be required to provide Sponsor with proof that he/she is the authorized account holder of the wireless phone number associated with the winning entry. If a dispute cannot be resolved to Sponsor's satisfaction, the affected entry will be deemed ineligible. Sponsor reserves the right to prohibit the participation of an individual if fraud or tampering is suspected, or if the individual fails to comply with any requirement of participation as stated herein or with any provision in these official rules. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAW.  SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor assumes no responsibility for undeliverable text messages resulting from filtration of a user’s wireless phone carrier network. Sponsor reserves the right to modify the Sweepstakes or disqualify entrant if fraud, misconduct or technical failures destroy the security, fairness or integrity of the Sweepstakes as determined by Sponsor, in its sole discretion. Proof of submitting entries will not be deemed to be proof of receipt by Sponsor. Any use of robotic, automatic, programmed or the like methods of participation will void all such submissions by such methods. In the event Sponsor is prevented from continuing with this promotion, or the integrity and/or feasibility of the promotion is severely undermined by any event beyond Sponsor’s control, including but not limited to fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state or local government law, order or regulation, order of any court or jurisdiction, or other cause not reasonably within Sponsor’s control (each a “Force Majeure” event  or occurrence), Sponsor shall have the right, in its sole discretion, to abbreviate, modify, suspend, cancel or terminate the promotion without further obligation. If Sponsor, in its discretion, elects to abbreviate the promotion as a result of a Force Majeure event, Sponsor reserves the right, but not the obligation, to award the prize from among all valid and eligible entries received up to the time of such Force Majeure event, in a random drawing. In no event will more prizes be awarded than stated in Rule #4.
